    JOINT STATEMENT
    BETWEEN THE GOVERNMENT OF MALAYSIA AND
    THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CHINA
    ON FRAMEWORK FOR FUTURE BILATERAL COOPERATION

    Malaysia and the People's Republic of China (PRC) (hereinafter referred to as “the two sides”) have enjoyed substantive and friendly relations, based on equality, mutual trust and benefit, in the political, economic, cultural, educational, defence and other fields since the formal establishment of bilateral diplomatic relations on 31 May, 1974. These relations have been strengthened by close contacts which have brought about an environment of harmony and amity. The friendly relations and cooperation between the two sides not only accord with the fundamental interests of the two peoples, but also contribute to the peace, stability and social and economic development in Asia and the world at large.

    As the 21" century approaches, both sides agree to work together on a Framework of Future Bilateral Cooperation so as to bring about an all-directional relationship and good neighborliness, friendship and cooperation based on mutual trust and support. In this regard, the two sides, sharing similar aspirations and objectives, hereby agree that priority be given to the following:

     

    1.      TO UNDERTAKE concerted efforts to further develop the bilateral relations and to promote lasting peace, stability and prosperity in the region and in the world at large.

    2.      TO MAINTAIN close and frequent contacts and exchanges of visits at all levels, including government leaders and officials, the private sector, and their peoples in order to contribute to a comprehensive and sustained development of Malaysia-PRC bilateral relations.

    3.      TO STRENGTHEN the mechanism of annual meetings between senior officials of their respective Foreign Ministries for consultations on bilateral, regional and international issues of mutual concern. The consultations will be hosted by the two sides alternately.

    4.      TO EXPAND friendly and mutually beneficial cooperation in the fields of trade, investment, banking and finance, defense, security, education, science and technology, information, health, transport, environment, agriculture, forestry, mining, culture, tourism, youth, and sports based on the principles of equality and mutual benefit, by undertaking the following:

        a)       To promote better bilateral trade and investment flows, and improve industrial cooperation by:

                          I.      Agreeing to provide a conducive market environment, through identification and removal of trade and investment impediments,

                         II.      Improving transparency of trade related regulations,

                         III.      Encouraging and supporting increased mutual investment, through more frequent exchanges of information.

                         IV.      Undertaking investment promotion, and joint investment in third countries, and encouraging a pro-active role for the business sectors of both sides. 

     

    b)       To intensify exchanges and cooperation in the field of finance. Each side will provide necessary facilities for the establishment and operation of the other's banks in its territory based on reciprocity. The two sides will work together to reform and improve the international financial regulatory system and to establish a new international financial order to the benefit of all sides.

     

    c)       To promote defence cooperation by facilitating the exchange of visits at various levels, including study visits, ship visits, training, exchange of information! intelligence, organizing of seminars, and undertaking mutually beneficial research and development besides exchange of high ranking military officers. In the area of defense industry, both sides will encourage reciprocal visits by officials of the defense industry companies and organize exhibitions, seminars and workshops to explore the possibility of identifying joint or co-production projects.

     

    d)       To promote cooperation and mutual assistance between their respective law enforcement agencies to develop closer contacts in the exchange of information on criminal matters and in preventing and combating organized cross-border crimes, economic crimes, trafficking of narcotic drugs and psychotropic substance, trafficking of firearms and explosives, trafficking of humans, and other criminal activities.

     

    e)       To enhance cooperation and. exchanges in the field of education, in line with the Memorandum of Understanding of 20ch June 1997, with special focus to be placed in the area of science and technology so as to enable the two sides to promote academic and technological exchanges.

     

    f)        To enhance cooperation in the fields of science and technology between the two sides, in accordance with the Agreement of Cooperation in Science and Technology of 13th July, 1992, with special emphasis being given to joint research and technological exchanges in areas of mutual interests and to forge greater consultation on issues of common concern at regional and international fora.

     

    g)       To enhance cooperation in the field of information and communication.

     

    h)       To promote cooperation in medical research, pharmaceutical production, traditional medicine, consumer protection, and epidemic prevention and control and to strengthen the coordination and cooperation between their governments and officials within the framework of UNESCO, UNICEF, WHO and other such international organizations that cooperate in the area of public health.

     

    i)         To enhance cooperation in the area of air, land and maritime transport. The two sides will jointly work to promote the Singapore-Kunming Rail Project of the Mekong Valley Development Program, which will serve the long term and common interest of not only Malaysia and the PRC, but also other countries in the region.

     

    j)         to promote cooperation in the areas of environmental management and sustainable development, to forge greater consultation on global environmental concerns including the implementation of Multilateral Environmental Agreements, promote stronger cooperation in information exchange such as on cleaner technology, environmental education and awareness and conservation.

     

    k)       To promote and expand technical and technological exchanges and to improve quality, production and added value of agriculture, forestry, mining and timber products.

     

    l)         To promote cultural exchanges in a structured and organized manner, and to consider the signing of a bilateral agreement on cultural cooperation.

     

    m)      To encourage the tourism sector of the two sides, to take steps to intensify bilateral cooperation, increase tourist arrivals, expand their tourism markets and improve marketing techniques.

     

    n)       to encourage and promote cooperation in the field of sports including in sports administration, training and sports medicine, and to establish closer cooperation in youth development and youth exchange programs.

    5.    TO AFFIRM the respect for the independence, sovereignty and territorial integrity of each other. The Malaysian side, in line with its “One China” policy, reaffirms its recognition that the government of the People's Republic of China is the sole legal government of China, and that Taiwan is an inalienable part of the territory of the People's Republic of China.

     

    6.      TO REAFFIRM that the United Nations Charter, the Five Principles of Peaceful Coexistence, the principles established in the Treaty of Amity and Cooperation (TAC) in Southeast Asia and other universally recognized principles, including the principle of noninterference in each other's internal affairs, should be the basic norms governing the relations between the two sides.

     

    7.      TO CONTINUE to strengthen consultations and cooperation on regional and international issues of common concern at ASEAN, ARF, APEC, ASEM, WTO, UN and other multilateral fora, so as to enhance regional and international peace and development.

     

    8.      TO ENHANCE the development of friendly relations between ASEAN and the PRC, recognizing that close Malaysia- PRC cooperation and the vital contributions made by both sides have helped promote ASEAN-PRC and ASEAN+3 (the PRC, Republic of Korea and Japan) relations.

    9.      TO MAINTAIN peace and stability in the South China Sea, and to promote the settlement of disputes through bilateral friendly consultations and negotiations in accordance with universally recognized principles of international law, including the 1982 United Nations Convention on the Law of the Sea.

     

    10.    TO PROMOTE the establishment of a multipolar world and a new equitable and rational international political and economic order.

     

    11.    TO REAFFIRM the right of each country to choose its own social, political and economic system and that no country shall interfere in other countries'internal affairs on whatever pretext.

     

    12.    TO PROMOTE the unity amongst developing countries and support developing countries to participate in international affairs on an equal footing and to take their rightful place in the new world order.

    This Framework for Future Bilateral Cooperation will be jointly reviewed by the Ministers of Foreign Affairs of the two sides at the request of either side. Any problem, dispute or difference which may arise shall be settled by mutual and friendly consultations between the two sides.
